Resumen

En el presente trabajo se discute la concepción kantiana acerca de las relaciones entre ética y derecho. En primer lugar, se considera el modo en que Kant sitúa el derecho dentro de la esfera de la moralidad. En segundo lugar, se examina la diferencia entre legislación moral y jurídica, a la luz de la distinción entre libertad interior y libertad exterior. Sobre esa base, se precisa la función del principio de coexistencia de libertades y la vinculación entre derecho y coacción. La posición compleja elaborada por Kant queda caracterizada por referencia al denominado “modelo motivacional” de la distinción entre ética y derecho.
