About the Journal

Objectives and Scope

Ratio decidendi focuses on the study of constitutional and conventional justice and the impact of its work in the different areas of law: constitutional, private, procedural, human rights and administrative law, among others, and its effect on state performance, especially in public policies.

The journal pursue to promote an enriching dialogue in the legal community about the performance of constitutional justice and its contributions to strengthening the rule of law, constitutional democracy and the edification of a common rationality in constitutional matters.

Ratio decidendi has an international vocation and call authors from all countries with the intention of encouraging the development of legal comparison and thus contributing to the generation of valuable and applicable legal knowledge in different legal enviroments.

Research papers (doctrine), academic studies of constitutional court and international court rulings, and review articles are welcome.

Ratio decidendi is an international, digital, open access, continuous publication, peer-reviewed, double-blind scientific journal. Its website is bilingual and receives papers in English and Spanish. The journal does not charge for publishing. Articles may have accompanying material in the form of a published dataset.

The journal complies with the good practices of scientific integrity within the framework of the Singapore declaration, and the COPE code of editorial ethics.

The journal is under the care of the Universidad Panamericana, who finances its publication, and agrees that the published articles will be available in perpetuity.

Adhesion to International Declarations

Ratio decidendi is committed to open access with good practice related to research, authorship and scientific publishing, thus promoting compliance with the following statements at the various stages involved in the publication process:

 

Preservation of digital archives

Ratio decidendi supports the CLOCKSS (Controlled Lots of Copies Keep Stuff Safe) system as a permanent and secure archive for the journal. CLOCKSS is an open code program developed by the Library of Stanford University that enables libraries to preserve selected web-based magazines. It regularly searches registered journals to compile and file newly published contents. Each file is continuously validated against records from other libraries, so any contents that may be damaged or lost can be restored using those records or the journal itself.

The journal is also stored and viewed in the institutional repository SCRIPTA, which is managed by the Libraryof Universidad Panamericana. SCRIPTA enables the preservation of the documents published by the journal as well as retrieval through the different repository networks worldwide. Additionally, as a preventive measure in the event of system failure or discontinuity of the publication, the institutional Library will preserve restricted copies of the documents to ensure their perpetuity over time.

 

Access and Publication Costs

In compliance with open access policies, Ratio decidendi provides free access to all published articles and encourages the sharing and dissemination of texts at no cost to readers. The journal, does not consider costs for authors associated with the publication of manuscripts.
